Boundary Disputes - anyone with legal experience or advice?

I'm round my folks place again today as the boundary dispute that has been going on since autmn 2000 has finally reached a point where a fencing contractor has been here since about 10am and is putting up a boundary fence. We are being as non-confrontational about it as humanly possible, but are making clear at each stage that the fence if we disagree with it will be removed. Anybody got any experience of this kind of thing - we are consulting various sources and double checking before we do anything, but i figured the MT members might be some help. Cheers in advance

My mum and dad have an ongoing boundary dispute with their neighbours. I would advise to stay calm and don't touch anything that is constructed (boundary markers, fences, wires etc) as this can be classed as criminal damage. Good luck, i know how much stress and angst it has/is causing my parents.

We've given notification by letter - sent via email to their legal representation again - that in 7 days the disputed fenceposts will be removed. This is as per the norm reaction as to not remove them is to passively agree that they are in the right place. We are in the ridiculous situation of dealing with people who tell you what to do, do not present any supporting documentation at all, have boundary surveys done which they then ignore, have staked markers put in at different times and in different locations marking more than one boundary line. We've been dealing with these people since 2000 - they are now on their 3rd set of legal representation; each time their threats of action have not come to fruition, and then they have come back to us much time later with another strongly worded letter from a new set of representation. We've been too passive about it for my liking - i'd rather they just said let's go to arbitration as we have a very strong case, photographic and legal documentation supporting our case predating their purchase of the land by some 15-20 years, and have taken every opportunity along the way to resolve the problem amicably. Very very frustrating - it's just new money people trying to throw their weight around and trying it on with the wrong people.

We have just received an email & attached letter which crossed in a matter of minutes with a letter sent by us giving 7 days notice of the disputed area of boundary having the fence removed. This one has really taken things too far as they have now alledged that the contractor putting up the fence was abused by us an my parents take that as a real affront as they have been nothing but pleasant in all encounters and have attempted to come to a fair conclusion at every meeting. It's pretty clear that they are trying to use any possible get out and are now claiming that we abused the guy putting up the fence when that claim couldn't be further from the truth and is an out and out lie. What they don't realise of course is that we openly filmed the chat with the contractor and have clear video and audio showing just what happened. It's clear to me that the people who wrote the letter after being advised by the people we're having the dispute with are not at all aware of this. Cheeky fcukers  Now threatened with an injunction from them and accused of abusing workers, despite the fact that any injunction would immediately need to present proof of who owns what land and where the boundaries are which hasn't been forthcoming in over 9 years!! Unbelievable!!
