Sure if both were putting money into the bank, person A put in £40k a year, Person B £20k a year, surely person B cannot claim 50%?

they can.

in the UK, the other person - typically the wife - claims she has become used to that standard of living, and is entitled to it once she leaves.

the courts agree with her.

Why? Because they believe there should be no financial disincentive to divorce - you shouldn't be scared away from divorce because you'd lose your standard of living.

It's a stupid, cruel and evil law. If you marry someone rich, that's a perk of being with them, you don't earn the right to squat imo.

Damn, just read that link, I ain't never getting divorced..!!! If the purpose of splitting it all is to not make someone scared of divorce financially, why does the guy get it in the nuts!??!?

Anyway, the take home message is, only marry someone you know you're gonna spend the rest of your life with. If you can't see yourself as that old couple doddering down the pier with their ponchos on, don't do it.

another moral of the story could be marry someone that earns more and has greater assest than you do!

interesting thread this, its something i worry about for sure, over the past few years ive got myself into a really good position, and to think someone could take what i have worked myself into the ground for makes me sick

my mother took the house, the money from the business and half his pension

some women can be twisted and money grabbing bitches when they see the divorce papers

ironic is that she cheated on my dad and she left with all the good and left my dad with all the bad

she now has two properties, one to rent and one to live in.... goes on expensive holidays 3 times a year with her new husband and drives a new car every few years.

my dad lives in a two bedroom flat, his business down the pan and has to work until he drops because his pension is worthless.

what hurts more is that the guy who knew all where my dads money was before the divorce was also the guy who was screwing my mum and is now her new husband. He was acting as his financial advisor

As far as I'm concerned, if one party cheats, that's game over for getting a single penny that's not been earnt/put away by them. Shame british law doesn't see it that way...

So what happens if the higher earner is a woman. Does that man then get a 50% cut or is it only for women to get a higher cut?

Its a very strange system for sure.

It does seem to favour the woman regardless.

My uncle got divorced from his wife last year. She kept their 4 kids, their house (which he bought with money inherited from his father) and all contents, 2 new mercedes (he has NO car), a huge chunk of money from his business (she has her OWN job!) and all other possessions of value.
He has to pay the mortgage, child support, her service charges (elec & gas) etc. etc.
I think he also has to shoulder all debt by himself.
Basically, when he got divorced, he lost everything.
The reason he wanted a divorce was because she was abusive!

He tried to get custody of the kids, she just did one simple thing which is becoming more and more common in Ireland by women nowadays:
She accussed her husband of sexually abusing their eldest son.

I think it must be lawyers advising people to do this.

The same thing happened one of my friends 3 years ago. He is still trying to get through the case, lawyers are dragging it out to make money.
She has been proven guilty of embezzlement, theft and it is also proved that she is not an EU citizen, she is Morrocan and lied on all papers.
For some bizzare reason, she hasn't been deported.
Shes a cheat and a cocaine addict besides and doesn't have a care in the world for their daughter.
Only wanted the daughter because she knew thats where the money was.

She was requesting bigger and bigger amounts of money and claiming that he hadn't ever paid.
His solution on advice of his lawyer was to live in debt so that she couldn't claim any profits from the divorce.
So the guy is driving a new bmw every year and has a beautiful boat, and bought a gorgeous house.
Has gigantic debt around his neck but at least she can't get any money.
I think he still has to pay welfare though!

Reading this post with great interest as will likely be in this sort of sutuation soon enough, been married for around 18 months now and TBH it never worked from the start. It's been nobody's fault, just we don't get on anymore and want very different things and have very different attitudes towards life. We are on our 4th "lets make a go of this one last time" attempt

However the house we live in was bought by me (the deposit, solicters fee's etc was bought from the profit of my first house) The mortage and all the bills have been paid for by me and she contributed very little towards anything.

Deep down we both know it's over but the house we live it is worth a hell of a lot more than what was paid for it and if we split and she gets half I am left with no house and doubt I could get onto the property ladder again due to house prices.

Sorry for the cynical first long time away back post and hello to anyone that remembers me!

He'd be heavily beaten. I'd take pleasure with her clothes and cut holes in them and throw them out of the window into the back garden. I'd then prolly break down at that point and never trust a woman again! (too many bad women in my life!).

Yes but what if she just lives with you for an extended period of time? My guess is the same rules apply....

I find the whole thing proposterous that someone could take half my business and house and in the case of some of the examples above, alot more.

To say you dont have to get married really isnt the point...

how about this,bought a run down property for 40k to rennovate as i am in the game, when i got divorced 10 years ago it got put on the market for 90k as it was still not fully completed new owners that bought it finished the works and 6 months later it was back on the market for 250k ,out of the initiall 90k i got awarded 20k,and the soliciter wanted 4k off that, thats divorce for you,

No, not necessarily. Altho it is more of a grey area and depends on individual contributions
