i've been summoned to court by the council and am wondering whether i should pay it or go to court and contest it
they are trying to do me for not paying council tax at a cost of £114, they are asking for £188 (after court costs, etc)
however i have phoned them on three seperate occasions to set up a monthly direct debit which it appears they are unable to do
they want me in court on the 16th
any opinions?

I`d pay it mate, amazing how they conveniently don`t have a record of your call unless it suits them  .

Yes. More info. For example were the three separate occasions well after the due date it should have started? And why did you need to ring them to do so - the info will have been on the back of the first bill. If, as is inferred, they are unable to do so over the phone why ring them more than once?
As is the case with many of these questions it's as much about what you've left out as what you've included. On that basis pay up.

i got a bill through so.....
on the first occasion i paid (well i think i did) via an electronic service
i got another bill (for the above)
so i phoned up and the person i spoke to told me that a direct debit had been set up
so i assumed that this was the case and it was paid, it was actually two times, i apologise

Time is money.
The amount of time wasted in or even outside the court on this issue and you could of made your money back picking pennies off the floor.

i paid them
£112.69 on 14th december 2007
and
£114.00 on 25th february 2008
the period listed in the summons is 11/11/2007 to 11/03/08

they will want you to clear the debt before they set up direct debit, i think once a debt is at court level they need it cleared or you are always in debt.

i dont know if you could do it in one call or not, i expect you can, ive been in your situation before and they said id have to pay it off, as at some stage it becomes a debt that has to be recovered and is essentially in a system of its own, at that point it blocks direct debits as if it just took that money and the debt wasnt cleared it would still be there as DD only takes a set amount each month.
Basically a direct debit wont clear whats outstanding but will only pay next months amount. This is why they wont let you set up a direct debit. If it takes 2 calls or 1 i dont know but id expect 1.
hope that helps. im not an expert, just relaying what i was told.

I'd ignore this less than helpful advice (he can hardly quote you when the credit rating goes to **** and the debt collectors turn up). Looking at what's been stated I'm guessing it's like something I managed to balls up recently.
I thought I'd paid one month but paid it so late they took as the next ones early payment. I then end up a month behind thinking I'm up to date and ended up paying a £45.00 fine together with the last and final payment.
In a similar way back when the poll tax reared it's rather ugly head I was out of work and said, in my rebellious way, '**** them'. Low I gets a job with the Met and while they were taking a case by case consideration on the tax as far as causing problems for Met employees I didn't wanna risk it. I ended up standing outside a court along with a bunch of others coming to a very late arrangement with the council.
Now the very nice lady tells me how much I have to pay etc. She mentions the calculated 'on the dole' discount but I got confused as to whether she'd taken it from the total or not. I was gutted when months later, thinking I'd paid my installments, I get a final demand with an additional fine to pay. £90.00 FFS! Cos I had defaulted. By accident but still.

I had a thing with my council tax, it's pointless fighting, someone said it to me in my thread and it's true...."you can't beat city hall".

feel for you mobster, i've just had a nightmare with bt and had to pay them £240 i shouldn't have had to
and now this?
is it any wonder people get in trouble with bills? as far as i knew i had set up a direct debit and could forget it
i had a similar probelm with scottish power not setting my dd's up as well last year

if you have records as proof you called them contest it. if not pay or it will cost you more in the long run mate.

Personally I'd pay £114 over the phone with my card but not the additional charges.
I had probs with business rates and they sent the bailifts round, I gave them nothing and accepted nothing... go on the phone and told them I could put it right, right now but I wasn't paying any extra... they were saying they had sent bills, I didn't recieve them. They let me pay it luckily and didn't charge me the extras.
