Mobile Phone Advice

In a bit of a crap situation with 02 atm. Ok so here are the facts :

1. been with them 8 years
2. bills etc always been paid on time
3. got upgrade in april to sony ericsson c905
4. broke in may, returned, repaired
5. broke in june
6. read on the net that its a crock of **** and has been plagued with problems and it has been discontinued.

rang o2 to give off and they said they no longer stock it and can repair my handset or offer me a lg renoir, tocco ultra or pixon. I have used sonys my whole life and there is a similar handset called the w995 which they apparently can't give me, this seems to be a lot of **** and in most ordinary circumstances in my life/uni/work i would tell them to stuff it, only prob is, ive just renewed my contract for 18months and 02 have the best reception where i live.

what options do i have?
does them giving me a handset which keeps breaking and malfunctioning constitute a breach of contract?
if i send them it back and cancel my direct debit will it affect my credit rating?

    If they have offered to repair or replace with a handset of similar value , then you don't really have a leg to stand on  ,as they are meeting their obligation. 

           If you are in a contracted period , and you cancel the DD , then yes it will affect your credit rating (you'll get a default) and you will have breached your contract with them , they would be within their rights to persue you for the cost of the remainder of the contract . 
           All you could do would be to barter with a CS rep on the grounds of your 8 years as a customer,  and explain that none of the offered handsets meet your requirements  - but there is no guarantee that you'd get anywhere with this.

    They won't offer you the W995 as it's a more expensive handset. Have you asked them what they would offer you it for - i would imagine you'll have to pay extra, or settle for a lesser model of SE.

    How much is your tariff?

    Did they offer you the LG Renoir HD? I've seen this in action, the picture quality is amazing for a mobile phone. I'd say go for it if you can.

    to be honest mate your lucky they didnt just repair it again

    the speaker problem on c905 is well known(by sony as well) and there is a new part to replace that

    sadly sony have produced some terrible phones over last few years k850i,w580i and the c905.
     
    It doesnt constitute a breach of contract as o2's side of the bargain is that they will supply you with a set number of minutes and texts, given the unreliability of phones (i'd say with a high spec phone you will more than likely need a repair within your contract) if you could cancel on that basis o2 (and the rest) would be fkced
     
    all the phones they have offered are decent, problem is they are touch screen so its getting used to that mate

    I think im gonna try getting it repaired off them one more time as apparently sony have a new part for the earphone in the c905 ( which is most common malfunction ), and fingers crossed it holds out. If it breaks again i'll just have to get one of those other phones i mentioned, but there all touch screen and i hate that, and plus im so used to sonys. Sony have really gone to the dogs this past few years though, i will be jumping ship next upgrade time for sure.

    tariff is about 40 something a month after vat mate, unlimited calls texts and internet.

    The samsung Tocco looks a nice phone just no keypad which put me off it.

    yea i know, all those phones they've offered me are touch screen, i couldn't have one of them. such an annoying situation. not really 02's fault i suppose, more sonys for making **** phones.

    Imo they should try and cater for your needs seeing as you have been there over 8 years, I would phone again and speak to a manager see what he could do.
